This study examines the metamorphosis of the concept of war in the modern era, particularly with the emergence of new forms of conflict such as non-kinetic warfare. These developments pose fundamental challenges to the laws of war, which were traditionally formulated based on conventional armed conflicts. This research is qualitative-analytical and employs a sociological approach. The main question is whether the current rules of international humanitarian law can adapt to the realities of emerging forms of warfare and if this situation has placed these laws on a path of conceptual evolution. The hypothesis is that traditional laws of war, due to their formulation based on conventional battles, face challenges in their application and interpretation for new forms of conflict. This lack of adaptability necessitates a shift toward an effect-based approach (instead of an instrument-based one). Despite this, fundamental principles like humanity and proportionality remain valid. The findings indicate that current laws are insufficient to address these challenges, and a revision of treaties and the formulation of new laws are necessary, with a focus on the devastation and human suffering caused, regardless of the tools used.
