چکیده
اختیار مقام قضایی در ارزیابی ادله که همان ابزارها و راه‌های رسیدن به کشف حقیقت هستند، قدرتی است که به وی داده می‌شود تا آزادانه بتواند ادله‌یمطروحه در پرونده را مورد ارزیابی قرار دهد. درواقع مقام قضایی در حوزه حقوق کیفری با مجموعه‌ای از ادله، قرائن، امارات و اوضاع و احوالی سرو کار دارد که به‌وسیله آن‌ها می‌تواند حقیقت پنهان در بطن ادله را استخراج کرده و در نهایت با قناعت وجدانی به صدور رأی عادلانه و منصفانه دست یابد امروزه دانش و فناوری‌های نوین علمی، گام‌های سریعی برای ورود به هزاره سوم برداشته‌اند و جامعه نیز به‌سرعت در حال دگرگونی و از سوی دیگر جرایم نیز در حال افزایش است؛ همین موضوع باعث تغییرات بنیادی در دانش حقوقی و طرز تفکر نسبت به آن شده و ضرورت برخورداری از یکپارچگی و کارآمدی اطلاعات و توسعه فناوری‌های اطلاعاتی و ارتباطی در ناجا را اجتناب‌ناپذیر نموده است. در حقوق موضوعه ادله اثبات جرم محدود به ادله سنتی شامل اقرار، بینه، قسامه (در صورت تحقق لوث برای اثبات قتل و جرح) و علم قاضی می‌باشد. لکن با پیشرفت و گسترش علوم تجربی در زمینه های مختلف، روش‌های علمی و تجربی جدیدی مانند پزشکی قانونی، انگشت‌نگاری، تشخیص هویت ژنیتیکی که همه در کشف حقیقت و حصول اقناع و وجدان قاضی و اتخاذ تصمیم عادلانه وی مؤثرند و می‌توانند به‌عنوان ادله جدیدی برای اثبات دعاوی کیفری قرار بگیرند. در عصر حاضر با پیدایش شیوه‌های جدید کشف حقیقت (ادله نوین) بحث از جایگاه آن‌ها در اثبات جرایم مستوجب حد و تعزیر ضرورت پیداکرده است.

چکیده [English]
The authority of the judicial authority in evaluating the evidence, which are the same tools and ways to discover the truth, is the power given to him so that he can freely evaluate the evidence presented in the case. In fact, the judicial authority in the field of criminal law deals with a set of evidence, evidence, emirates and circumstances, by means of which he can extract the hidden truth in the heart of the evidence and finally reach a just and fair verdict with conscientious satisfaction. Today, new scientific knowledge and technologies have taken rapid steps to enter the third millennium, and society is also changing rapidly, and on the other hand, crimes are also increasing. This issue has caused fundamental changes in legal knowledge and the way of thinking about it and has made the necessity of having the integrity and efficiency of information and the development of information and communication technologies in Naja inevitable. In the subject law, the evidence to prove the crime is limited to the traditional evidence, including confession, testimony, oath (in case of proof of murder and wounding) and knowledge of the judge. the judge and making his just decision and can be used as new evidence to prove Criminal lawsuits are filed. In today's era, with the emergence of new methods of discovering the truth (new evidence), it has become necessary to discuss their place in proving crimes subject to the limits of confines.
