Abstract
Since victimization has emotional, physical, financial, psychological, and social consequences, The intended support must also be comprehensive and cover all effects. Victims in the process of various criminal justice systems, along with other actors, need legal support in order not to be sidelined and to achieve their lost rights, along with other necessary support. This research is descriptive, analytical and uses a case-finding method, and raises the question of what extent the Criminal Procedure Code approved in 2013 has provided the necessary legal protection for the victim based on secondary or supportive victimology at different stages of the proceedings? The research aims to analyze and analyze legal protections in the Iranian legal system, with the priority of the Criminal Procedure Code approved in 2013 with subsequent amendments, which is the Code of Criminal Procedure in force in the Iranian legal system. Considerable legal protection for victims during the preliminary investigation stage includes the recognition of the victim's status in Articles 10, 11, and 12 of the Criminal Procedure Code, the right to access the criminal justice system, the possibility of claiming compensation, free support in detecting crimes, etc. During the trial stage, he mentioned the right to have more lawyers, to demand damages and blood money without the requirements of legal cases, to interfere with the public or private nature of the proceedings, etc., and during the execution stage, he mentioned the permanence of the victim's private rights in the event that the prosecution is suspended, the priority of receiving damages over criminal compensation, and interference in the execution process of the verdict, etc. In addition, the lack of mandatory appointment of a lawyer for victims and defendants at different stages of the trial, depending on the type of crime, the lack of free community support that covers all litigation costs for victims to fully recover private losses suffered by victims and defendants, and the inability to retry the trial from final decisions to the detriment of the victim are also challenges in this area.
