Investigation of targeted terror and violations of international human rights laws from a legal perspective (Case study: Targeted assassination of IRGC Quds Force Commander)

Abstract

Targeted terror has been a common policy among governments in order to advance security goals. This terror may occur in different situations and conditions, which can be carried out by government in armed conflicts or even peace. tools are not very important in this assassination. This concept has undergone many changes after the events September 11. although it is a policy and a tool of war that is still considered legal and legitimate in international law, its currently considered by some countries like the US as a terrorist tool that is not acceptable in the international community. there is need to examine and analyze the doctrine of a completely legal approach to the issue of "targeted terror" from the perspective of international humanitarian law and international human rights. "Target" in its military application means the person or place or object attacked; Therefore, the act of targeting means directing the operation to the direction where the target should be attacked. however, the concept of "terror" in the combination of "targeted terrorism" is the same as the combination of extrajudicial declaration in terms of terminology, and in terms of the goal, which they have in common; But from the legal point of view, they have conceptual differences. The American military action in the direction of the targeted assassination of the IRGC Quds Force commander is in clear contradiction with the principles and conditions of legitimate defense and is a gross violation of the rules of international and international humanitarian law. The international community and international institutions should seek to guarantee appropriate executions for such actions against the UnitedStates.
